Update on Settlement of Kernersville Sewer Service Class Action for Overpayments

If you were a customer of the Town of Kernersville, North Carolina’s sanitary sewer system between mid-2012 and mid-2016, you may be eligible to receive a refund of sewer fee overpayments. For more information about this case, please visit www.kernersvillesewersettlement.com.

Alan W. Duncan and Stephen M. Russell, Jr. have been appointed as Class Counsel in this case, Fasano v. Town of Kernersville, et al., along with colleagues at another firm. The North Carolina Superior Court, Forsyth County, has preliminarily approved a $12.3 million settlement that, upon final approval, would result in approximately 11,000 Class Members receiving significant refunds. The settlement resolves litigation over whether the overcharges to Class Members violated federal and state law. The Court has scheduled a final approval hearing in this matter for July 27, 2018.
